Privacy Policy
1. Scope of This Policy
This Privacy Policy explains how Gorinshteyn & Watkins, LLC (“G&W,” “Firm,” “we,” “us,” or “our”) collects, uses, discloses, retains, and safeguards information when you access www.gwtrial.com or its official content channels, request information, contact the Firm, participate in a consultation or representation, enter an event or prize drawing, or use a Firm text-messaging program.
Our duties to clients and prospective clients under applicable law and professional rules, including confidentiality, privilege, and conflicts obligations, apply independently of this Policy and are not limited by it. An engagement agreement may address additional information practices connected with representation. This Policy provides notice; it does not itself constitute consent for activities that require a separate authorization.
2. Categories of Information We Collect
Information you give us
-
Contact and identity information, including your name, mailing address, email address, telephone number, and preferred method of contact.
-
Inquiry and intake information, including descriptions of a possible legal matter, parties involved, requests for consultation, communications, and documents you choose to provide.
-
Client and case information, when relevant to a matter, such as insurance, claims, medical, financial, employment, billing, identity-verification, transaction, court, and other records, some of which may be sensitive.
-
Event and prize information, including an entry keyword, telephone number, name or email address if requested, timestamp, entry number, consent/eligibility records, verification responses, winner-selection records, and prize-delivery or tax information when applicable.
-
Communications and preference information, such as emails, texts, call details, service requests, marketing enrollment choices, unsubscribe/STOP requests, and records of consent.
Information collected from devices or other sources
-
Website and technical data that our hosting, security, analytics, or similar providers may collect, such as IP address, browser type, device identifiers, approximate location inferred from a connection, referring pages, page views, access times, and interactions.
-
Cookies, local storage, pixels, and similar technologies to the extent they are used on the Website or embedded third-party content. The specific tools may change as our Website and providers change.
-
Information from public records, courts, insurers, medical providers, experts, authorized representatives, referring lawyers, counterparties, and other sources when lawful and reasonably necessary for an inquiry or matter.
Please do not put Social Security numbers, financial credentials, medical records, legal deadlines, or confidential case narratives into public comment areas, promotional text messages, or general registration fields. Contact us for an appropriate means to transmit sensitive material.
3. How We Use Information
Depending on the context, we use the information described above to:
-
Respond to your contact requests, schedule consultations, conduct conflict checks, assess potential representation, and provide legal services when engaged.
-
Operate case files and business functions, including billing, administration, records, security, quality control, and permitted technology-assisted document and workflow support.
-
Process event participation, determine eligibility, log entries, provide confirmation or entry numbers, select and notify winners, and fulfill prizes under the applicable Official Rules.
-
Send messages you request or have separately agreed to receive, document consent, honor opt-outs, and avoid sending communications to people who have withdrawn consent.
-
Operate, secure, diagnose, improve, and understand use of our Website and online services.
-
Protect against fraud, misuse, security threats, and unauthorized activity and comply with legal, professional, regulatory, tax, recordkeeping, and dispute-resolution obligations.
We do not treat your acceptance of this Privacy Policy or the submission of a basic contact form as a blanket authorization for recurring promotional texts or automated marketing calls. We obtain any separate consent the law requires.
4. Lawyer Confidentiality and Prospective Clients
A website visit, public comment, event entry, automated confirmation, or unsolicited submission does not alone establish an attorney–client relationship. Nonetheless, a qualifying consultation by a prospective client may be subject to applicable ethical protections even when we do not undertake representation. We do not use or disclose protected information in a manner inconsistent with those duties.
We may use appropriately supervised professional and technical service providers to support legal work, subject to applicable confidentiality, data-security, and professional-responsibility requirements. No provision in this Policy authorizes a provider to use protected client or prospective-client information for its independent marketing.
5. Cookies, Analytics, and Embedded Content
Our Website and supporting providers may use necessary cookies and similar technologies for operation, security, basic preferences, site measurement, and content display. Some analytics, advertising, or embedded-media providers may separately collect identifiers, usage information, and interactions under their own notices. We do not represent that every third-party feature is controlled by the Firm.
You may manage cookies through your browser and any controls provided on the Website. Disabling cookies can affect site functionality. Where applicable law requires opt-in consent, an opt-out choice, or recognition of a legally effective browser preference signal (including Global Privacy Control where applicable), we will implement and honor the required mechanism. Browser “Do Not Track” signals are not treated as a universal consent or opt-out mechanism.
Our Website may link to or display third-party videos and social feeds, which are independently governed by the respective providers’ policies. Merely following the Firm or viewing publicly available legal commentary does not authorize Firm SMS marketing.
6. Disclosure and Sharing of Information
We may disclose information as reasonably necessary for the purposes in this Policy, subject at all times to applicable law, privilege, professional confidentiality, and our agreements:
-
Service providers supporting hosting, security, telecommunications, SMS transmission, intake, events, practice administration, IT, document storage, technology-assisted processing, payments, accounting, and related services, only for authorized purposes and subject to appropriate restrictions.
-
Counsel, courts, experts, insurers, claims participants, investigators, and other parties in connection with a legal matter, where authorized or otherwise permitted.
-
Event administration and prize-fulfillment providers to administer entries, contact winners, verify eligibility, issue prizes, and satisfy applicable reporting requirements.
-
Regulators, courts, and other recipients where disclosure is legally required or permitted; a request does not automatically override a privilege or ethical duty.
-
Persons or organizations you authorize; and, subject to professional rules and any required notice or consent, parties to an authorized reorganization or transfer of the Firm or its practice.
We do not sell client files, event registration lists, or personal information for monetary consideration, or provide those records to other organizations for their own direct marketing. We do not authorize outside advertisers to market independently to you based on your participation in our text programs.
Mobile phone numbers, SMS opt-in, and consent records
WE DO NOT SELL, RENT, OR SHARE MOBILE PHONE NUMBERS, SMS OPT-IN INFORMATION, OR TEXT-MESSAGING CONSENT WITH THIRD PARTIES OR AFFILIATES FOR THEIR OWN MARKETING OR PROMOTIONAL PURPOSES. We may provide relevant information to vendors working on our behalf solely to operate, support, secure, and document the messaging program, or to recipients where disclosure is legally required. Consent given to G&W is not assigned to another organization for independent advertising.
7. Event Registration, Text-to-Enter, and Prize Drawings
For a text-to-enter promotion, we may receive the incoming phone number, keyword, time, message content, delivery metadata, and any information requested for eligibility, confirmation, or prize fulfillment. We use this information to process and verify the entry, administer the drawing, respond to requests, identify and notify winners, and document compliance with the Official Rules.
When a promotion also permits a web form or other method of entry, that method may ask for your name, email, phone number, and other limited eligibility information. If the form offers an optional welcome text, that choice will be separately presented and unchecked by default; a one-time confirmation is not consent to ongoing advertising.
A prize entry, a texted keyword, and an optional event-confirmation SMS are not blanket consent to receive recurring marketing texts, automated advertising calls, or marketing emails. Any additional promotional enrollment is separately identified and requires whatever affirmative permission is legally required. Declining or revoking marketing permission does not invalidate an otherwise eligible entry or alter the odds of winning.
Winner identity or likeness will not be published merely because someone entered. Any proposed winner publicity will follow the promotion’s Official Rules, any additional required consent, and applicable law. Entries and contact data will be retained as reasonably necessary for administering and documenting the promotion.
8. Telephone, Text, and Email Communications
Event-related texts
If you initiate a text-to-enter request or separately opt into a one-time welcome message, we may use automated technology to provide the limited responsive messages described in the event disclosure and Website Terms. Text-to-enter messaging may include an entry acknowledgment, necessary registration or verification steps, and a permitted prize-related response. The one-time website-registration program ordinarily sends one welcome message per consenting registration.
Expected message frequency for each event is provided in its call-to-action. Message and data rates may apply. Message delivery may fail or be delayed, and carriers do not guarantee delivery. Participants should not send confidential legal information by event text.
Separate recurring or promotional programs
If the Firm offers an additional marketing SMS or automated-call program, enrollment information will describe its contents and expected frequency, and we will obtain the applicable consent, including written consent when legally required. Consent is not a condition of obtaining legal services or entering or winning a prize. We maintain records of enrollment and withdrawal.
Opt-outs and contact preferences
Reply STOP to a program text to opt out and HELP for assistance. You may also contact Info@GWTrial.com or 404-618-0808, or use another reasonable opt-out method recognized by law. We honor valid requests within applicable legal deadlines and may send a single lawful nonmarketing confirmation. An SMS opt-out does not itself end representation or cancel an accepted entry; we may use another lawful communication method as appropriate.
Marketing emails include required unsubscribe methods. An unsubscribe generally does not stop nonmarketing messages about an active legal matter, a requested consultation, or a prize entry where law permits those messages.
9. Retention and Disposal
We retain information only as long as reasonably necessary for representation, inquiries, event administration, consent and suppression records, operations, legal claims, audit trails, preservation duties, and applicable legal or professional obligations. The relevant period depends on the information, purpose, matter, and required retention rules; no single period applies to every record.
Certain consent and opt-out records may be retained after a person unsubscribes to demonstrate compliance and prevent unwanted outreach. When information is no longer needed and is not subject to a hold or other obligation, we take reasonable steps to delete, destroy, or deidentify it as appropriate.
10. Security and Information Handling
We use reasonable administrative, technical, and physical safeguards suitable to the sensitivity of the information and our professional obligations. Safeguards may include access limitations, authentication, provider oversight, backup practices, and staff controls as appropriate. No online system or transmission is completely secure.
If you believe information entrusted to us has been misdirected, accessed without authorization, or otherwise compromised, contact us promptly at Info@GWTrial.com or 404-618-0808.
11. Privacy Requests and Choices
Depending on where you reside, our operations, and the laws actually applicable to the Firm, you may have rights to request access, correction, deletion, portability, withdrawal of consent, or opt-out of certain uses or disclosures. Applicable law may also permit appeals and provide protection against unlawful retaliation for exercising rights. These rights are not universal and may be subject to exceptions.
To make a request, contact Info@GWTrial.com or 404-618-0808. We may take reasonable steps to verify identity and authority where lawful. Requests will be evaluated under the laws that apply and may be limited by privilege, other people’s rights, client confidentiality, legal holds, recordkeeping duties, or the need to establish, defend, or exercise legal claims.
An SMS unsubscribe does not withdraw a drawing entry. If a separate request to delete essential entry information would make participation impossible, we will explain the effect, to the extent feasible and appropriate, before implementing the request.
12. Minors
Our general Website content is not directed to children younger than 13, and we do not knowingly solicit their personal information online without required authorization. Unless specific Official Rules lawfully provide otherwise, our promotional entry and SMS programs are limited to adults at least 18 years old.
The Firm may process minors’ information in the course of lawful legal representation, including communications with a parent, guardian, or other authorized person; this is distinct from event registration.
13. Third Parties and Processing Locations
External links, platforms, and embedded content are operated by others; review their privacy practices before submitting information. The Firm is based in the United States. Authorized service providers may process information in the United States or other jurisdictions as permitted by applicable confidentiality, security, and privacy requirements.
14. Changes to This Privacy Policy
We may revise this Policy when our operations, legal requirements, or technology change. We will publish the updated version and effective date and provide additional notice or consent if required by law. A policy update is not an enrollment mechanism and does not expand earlier marketing consent.
