Terms & Conditions
1. Scope; Acceptance; Priority of Documents
These Terms & Conditions (the “Terms”) govern access to and use of www.gwtrial.com and its associated pages, articles, videos, downloadable materials, forms, and official Firm-controlled social media profiles (collectively, the “Online Content”), as well as participation in Firm-operated text messaging programs, promotional events, marketing, and other events. “Firm,” “G&W,” “we,” and “our” mean Gorinshteyn & Watkins, LLC.
By using our Website or voluntarily taking part in a program that expressly references these Terms, you agree to the applicable provisions to the extent permitted by law. Some social media platforms or other third-party services have their own governing terms, which also apply. If you disagree, do not use the affected feature or program. Merely receiving an unsolicited communication does not constitute acceptance of a contract.
Our Privacy Policy describes how personal information is handled. Each prize promotion has separate event-specific “Official Rules,” which control eligibility, entry, prizes, winner selection, and prize fulfillment. In the event of a conflict, the Official Rules control the promotion, these Terms control Firm messaging and Website use, and an executed legal-services engagement agreement controls representation. Mandatory law and professional obligations always prevail.
2. General Information; No Legal Advice
Our articles, videos, social media posts, website statements, downloadable resources, advertisements, and event communications are provided for general informational purposes. They are not legal advice or a substitute for advice from an attorney familiar with your circumstances. Law, procedure, deadlines, and outcomes depend on jurisdiction, facts, and changes in law. Content may be incomplete or become outdated; we undertake no general duty to update historical publications.
Statements concerning past cases, settlements, verdicts, client experiences, fees, and results do not promise or predict any particular outcome. Each matter is different. Publication of content about a jurisdiction does not represent that every Firm lawyer is admitted or available to practice there.
3. No Attorney–Client Relationship; Confidential Communications
Visiting the Website, following an account, commenting on a post, sending an unsolicited message, requesting information, completing an intake form, entering a promotion, or texting an event number does not, by itself, create an attorney–client relationship or obligate the Firm to represent you. Representation begins only when the Firm affirmatively agrees to undertake the matter, ordinarily through an engagement agreement.
A person who consults with the Firm concerning potential representation may have protections under applicable law and professional rules even when representation does not begin. Nothing in these Terms disclaims those duties or waives the attorney–client privilege, the duties owed to prospective clients, or any obligation under an actual engagement agreement.
Please do not send case-sensitive information, medical records, financial identifiers, passwords, deadlines, or other confidential materials through public comments, event texts, or general forms without first receiving instructions for an appropriate channel. Electronic communications may not be secure. An inquiry does not guarantee conflict clearance, a response, or preservation of a legal deadline.
4. Ownership and Limited Use of Firm Content
Except as otherwise indicated, the Website, the Firm’s original videos and social-media posts, scripts, articles, graphics, photographs, logos, names, layouts, and other creative content are owned by the Firm or used with permission from their owners. Applicable copyright, trademark, and other laws protect that material. All rights not expressly granted are reserved.
We grant a limited, revocable, nonexclusive permission to view the publicly available Online Content and to print or download a reasonable portion for personal, noncommercial, lawful reference, provided attribution, notices, and context remain intact. This permission does not authorize publication, commercial exploitation, derivative works, data scraping, systematic archiving, automated extraction for model training, copying of video or written scripts, or use of our name or materials in another party’s advertising.
Without prior written authorization, you may not reproduce, edit, repackage, repost, syndicate, publicly display, sell, license, distribute, or otherwise exploit substantial portions of our Online Content. You may not imply that G&W created, sponsored, endorsed, collaborated in, or approved your content, business, service, publication, or viewpoint. Nothing in these Terms restricts rights that cannot lawfully be restricted, including fair use and legally protected quotation, commentary, or criticism.
5. Hyperlinks, Embedding, Framing, and Social Media Sharing
No general permission to link or associate with G&W
We do not give blanket consent or an implied license to link to, frame, embed, mirror, or otherwise integrate our Website or Online Content into another website, advertisement, publication, social media page, application, or commercial communication. Anyone seeking to use our name, logo, likeness, content, or a link in a way that suggests sponsorship, approval, recommendation, association, referral, affiliation, or endorsement must first obtain our express written approval.
Unless expressly authorized, we prohibit framing, inline display or embedding that makes our material appear to be part of another party’s offering; use of our content or links adjacent to false, defamatory, deceptive, infringing, or unlawful material; and the creation of “official” pages or profiles impersonating the Firm. Deep linking or repeated linking designed to bypass access controls, mislead users, extract our content, or exploit our reputation is prohibited.
Limited ordinary references; reserved rights
This policy is not intended to prohibit lawful, nonmisleading references by government agencies, search engines, news media, legal directories, or other persons acting within rights provided by law. Nor does it prohibit ordinary platform-native sharing of a Firm post where authorized by that platform and the share preserves attribution and does not falsely suggest our endorsement. Such conduct does not create a license to copy the underlying content or use the Firm’s marks.
All other proposed promotional, commercial, partnership, or branded linking or embedding arrangements require prior written approval from Info@GWTrial.com. We may condition, refuse, or revoke an authorization and request that objectionable links or associations be removed. We reserve all legal remedies available against infringement, impersonation, misrepresentation, and unlawful use; these Terms do not purport to prohibit linking activity protected by applicable law or to bind persons who have not agreed to them.
6. Comments, User Submissions, and Social Platforms
If a Website feature or social media account permits comments, messages, reviews, or submissions, you are responsible for your content and must not post confidential details about another person; threats; unlawful, infringing, defamatory, fraudulent, harassing, or deceptive material; spam; or advertising that falsely claims Firm approval. We may moderate, hide, or remove material from channels we control, or restrict access, subject to law and platform rules.
Publicly tagging or mentioning G&W does not entitle you to a response or representation. We do not endorse user comments, outside testimonials, or third-party statements simply by hosting, replying to, or failing to remove them. We do not treat any unsought review or suggestion as permission to use a client’s identity, confidential information, or likeness in Firm advertising.
Third-party platforms (including video and social media sites) independently control their services, algorithms, data collection, and moderation. Use of those services is also subject to their respective terms and privacy policies.
7. Acceptable Use and Website Security
You agree not to use the Website or our controlled messaging programs to impersonate another person, interfere with normal operations, attempt unauthorized access, transmit malicious code, harvest personal information, circumvent security measures, overload services, or engage in illegal or fraudulent activities. We may suspend access or report unlawful conduct, subject to applicable duties to clients and prospective clients.
8. Text Messaging Programs (SMS/MMS)
8.1 Program identity and coverage
The sender is Gorinshteyn & Watkins, LLC. These provisions cover limited-purpose event and prize-drawing texts, optional welcome or entry-confirmation messages, messages responding to an inquiry, and any separate promotional program that the Firm expressly offers. Specific sign-up materials or Official Rules will identify the sender number or short code, keyword, event, message frequency, and other material conditions.
8.2 Text-to-enter prize promotions
If an event announcement invites you to text a stated keyword to a stated number, sending that text requests entry in the identified drawing and authorizes only the responses reasonably connected with that request, as described in the event advertisement and Official Rules (such as an entry acknowledgment, a necessary eligibility or verification prompt, a prize-related notice, an answer to your request, or an opt-out confirmation). The program is not a subscription to ongoing advertising.
An SMS transmission is not proof of an accepted entry. Entries must satisfy the Official Rules and any stated registration/verification process. If registration requires additional information, failure to provide it by the announced deadline may render the attempted entry incomplete. The Official Rules will identify any free alternative method of entry that does not require sending a text. A purchase, paid legal service, or consent to marketing is not required to enter or win.
8.3 Optional website-registration welcome program
When we provide a registration form that offers a separate, unchecked checkbox for an optional welcome text, selecting that checkbox authorizes the described one-time automated message identifying G&W and confirming the registration or assigned entry number. Where a contact person or direct contact details are included, the enrollment disclosure will identify them. The welcome-text consent is optional and is not required to register, enter, win, or retain legal services; declining or withdrawing it does not change an otherwise eligible entry or its odds.
If an event uses only text-to-enter, rather than a website form, its corresponding text-to-enter disclosure and Official Rules govern entry confirmation. Neither pathway, standing alone, authorizes an unrelated marketing campaign.
8.4 Promotional texts require separate consent
We do not treat event entry, a one-time welcome opt-in, the provision of a telephone number, acceptance of these Terms, or submission of an intake form as blanket authorization to send recurring promotional texts or automated marketing calls. Any separate marketing program will describe the type of messages, expected frequency, sender, and consent mechanism, and we will obtain the consent required by law. Marketing consent is not a condition of obtaining legal services or entering a drawing.
8.5 Frequency and charges
For the optional website welcome program, the standard frequency is one welcome message per completed, consenting registration, plus requested HELP responses and any permitted STOP confirmation. For text-to-enter drawings, frequency depends on the specific event and may include an acknowledgment and reasonably necessary entry, verification, or winner-related responses; the event’s call-to-action will give the applicable expected frequency before entry. Any recurring marketing program will disclose its own frequency at enrollment. Message and data rates may apply. G&W does not impose a separate SMS participation fee.
8.6 STOP, HELP, and other opt-out methods
Reply STOP to a program message to discontinue that program; reply HELP for assistance. You may also request assistance or withdraw consent by emailing Info@GWTrial.com, calling 404-618-0808, or using another reasonable method recognized by law. We process valid requests within applicable legal deadlines. Where lawful, a single nonmarketing confirmation message may be sent following an opt-out.
An opt-out does not, by itself, withdraw a properly submitted sweepstakes entry, end attorney representation, or prevent lawful nonmarketing contact through another channel. If we need to communicate with a winner after an SMS opt-out, we will use any alternate contact method permitted by the Official Rules and applicable law. Participants should ensure that any required alternate contact method is supplied.
8.7 Delivery, eligibility, and privacy
You must be at least 18 to enroll in an event SMS program, and must be the subscriber or authorized user of the number used. Carrier compatibility, filtering, network availability, and delivery times vary. Carriers are not responsible for delayed or undelivered messages. Messages may fail or arrive late, and no particular delivery time is guaranteed. Event terms govern whether and how a failed entry may be corrected.
Do not use event texts for emergencies, litigation deadlines, privileged materials, or urgent legal requests. For treatment of phone numbers and SMS opt-in information, see our Privacy Policy. G&W does not sell, rent, or share SMS opt-in data or messaging consent with third parties or affiliates for their independent marketing or promotional purposes.
9. Events, Sweepstakes, and Prize Drawings
Each promotion is governed by separately published Official Rules specifying the eligible participants, geographic area, entry period, permitted entry methods (including a free alternative where appropriate), entry limits, description and approximate retail value of prizes, odds or how odds are determined, winner-selection process, notice and claim deadlines, taxes, sponsor, and other material conditions. Review those Rules before participating. To the extent the rules identify a contest of skill rather than a random drawing, its selection criteria will be stated.
NO PURCHASE OR PAYMENT IS NECESSARY TO ENTER OR WIN A CHANCE-BASED PROMOTION. A PURCHASE, PAYMENT, LAW-FIRM CONSULTATION, OR RETENTION OF LEGAL SERVICES WILL NOT IMPROVE YOUR ODDS. SMS messaging consent for future advertising is not an entry condition. Void where prohibited or restricted by law.
Participating in or winning a promotion does not establish an attorney–client relationship, constitute a legal-services referral, or provide preferential treatment in the Firm’s practice. Any publicity release, publicity use of a winner’s identity, or personal information disclosure must be authorized by the applicable Official Rules and applicable law; an entry alone is not blanket consent to publish private information or use a person’s likeness.
10. Third-Party Links, Cookies, and Privacy
Our Website may contain links to third-party sites or embedded third-party media. We do not control or endorse their content, security, availability, or policies by linking to them. Their operators may collect data under their own policies. Our Privacy Policy describes our data practices, cookies, contact preferences, and available privacy rights. Acceptance of these Terms is not consent to marketing or to tracking practices where separate consent is required.
11. Website Availability; Disclaimers
We try to keep the Website accurate and accessible, but it and the publicly available Online Content are provided “as is” and “as available,” without any representation that they are error-free, uninterrupted, complete, or current. We may change or discontinue public Website features without advance notice. We do not guarantee that a message, form, or electronic inquiry will be delivered, received, or reviewed by a particular time.
To the fullest extent permitted by applicable law, we disclaim warranties relating solely to publicly provided Website technology and informational content. Nothing in these Terms excludes liability that cannot lawfully be excluded, alters an engagement agreement, limits our duties of professional competence or confidentiality, or waives remedies for legal malpractice, fraud, willful misconduct, or other nonwaivable rights.
12. Limitation of Liability; Third-Party Misuse
To the maximum extent permitted by law, the Firm will not be liable for indirect, incidental, special, or consequential losses attributable solely to interruption or ordinary use of publicly available Website functions, third-party platform outages, or messaging-delivery failures. This limitation does not apply to the Firm’s legal services, duties to clients or prospective clients, violations of applicable privacy or communications laws, or other liability that may not lawfully be limited.
If you unlawfully reproduce or misuse our content, impersonate the Firm, or knowingly introduce harmful material, you are responsible for your conduct and any remedies available under applicable law. No provision creates an obligation to indemnify us for our own misconduct or other liability that cannot lawfully be shifted.
13. Changes; Governing Law; Severability
We may update these Terms with a revised effective date. Changes will apply prospectively except as lawfully provided, and any additional notice or consent required by law will be obtained. Updating these Terms alone will not expand an existing consent to receive automated or marketing messages. Published Official Rules for an active promotion will not be materially changed except as those Rules and applicable law permit.
To the extent governing law may be chosen for general Website disputes, Georgia law applies without regard to conflict-of-laws principles. This does not override a mandatory consumer-protection rule, professional obligation, applicable court rule, or the governing law of an engagement agreement. If a provision is unenforceable, the remainder continues only insofar as permitted by law.
